The Challenge

Immersion offers such a service.

According to Tom Kristofco, President of Business Continuity Concepts, and someone who has worked in helping clients prepare for data breach incidents, “One of the biggest challenges is that state and federal regulations require that notifications be 'in the mail' within a certain number of days. Given the complex nature of a data breach, the notification timeline is often condensed to days not weeks. In addition, state attorney generals have the ability to enforce fines and penalties for failure to notify within the required time frame relative to their own state statute as well as the HITECH (Health Information Technology for Economic and Clinical Health) federal statute.”

Organizations that experience a data breach face a number of challenges. After determining the size and scope of the data breach, the organization needs to figure out what information has been compromised and what partners are needed to effectively respond to the incident.
